1. Agreement to Terms

Welcome to Band Traveler (the "App"), provided by Max Dig AS ("we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of the App and its services, which are designed to help musicians share logistics with their band members when traveling. By accessing or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

Please also review our Privacy Policy, which explains how we collect and use your information.

2. User Accounts

To use certain features of the App, you must register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete. You are responsible for safeguarding your password and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

3. Use of the App & User Conduct

You agree to use the App only for its intended purpose: to share and manage travel logistics with your band members. You are responsible for all information, data, and content that you upload, post, or otherwise transmit via the App ("User Content"). You agree not to use the App to:

• Upload or share any content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, invasive of another's privacy, hateful, or racially, ethnically, or otherwise objectionable.
• Impersonate any person or entity or falsely state or otherwise misrepresent your affiliation with a person or entity.
• Upload or share any User Content that you do not have a right to make available under any law or under contractual or fiduciary relationships.
• Interfere with or disrupt the App or servers or networks connected to the App.

4. User Content & Responsibility

You retain all ownership rights to your User Content. However, by submitting User Content to the App (e.g., travel details, notes), you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, modify (for formatting purposes), display, and distribute such User Content solely for the purpose of operating and providing the App's services to you and your band members within your designated groups.

You are solely responsible for your User Content and the consequences of sharing it. We do not endorse any User Content or any opinion, recommendation, or advice expressed therein, and we expressly disclaim any and all liability in connection with User Content.

5. App Availability and Modifications

We reserve the right to modify, suspend, or discontinue, temporarily or permanently, the App or any service to which it connects, with or without notice and without liability to you.

6. Intellectual Property

The App and its original content (excluding User Content), features, and functionality are and will remain the exclusive property of Max Dig AS and its licensors. The App is protected by copyright, trademark, and other laws. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.

7. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

8. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL MAX DIG AS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (A) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE APP; (B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE APP; OR (C) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT.

9. Termination

We may terminate or suspend your account and bar access to the App immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever, including but not limited to a breach of the Terms.

10. Governing Law

These Terms shall be governed and construed in accordance with the laws of Norway, without regard to its conflict of law provisions.

11. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will make reasonable efforts to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our App after those revisions become effective, you agree to be bound by the revised terms.
